Hi all,
Vanilla are planning an update to the site on April 24th (next Wednesday). It is a major PHP8 update which is expected to boost performance across the site. The site will be down from 7pm and it is expected to take about an hour to complete. We appreciate your patience during the update.

I just got knocked off my bike

    took a trip into hospital via ambulance & am home now with minimal damage to my health but my bike is in bad shape(value ~€1500)

    have 3 witnesses to confirm it wasnt my fault but the girl that knocked me down is early 20's i'd say & had some damage done to her expensive newish car(maybe about 1k worth of damage)
    this is my first accident & im not out to try clean anyone out for damages but just want to get my bike sorted(handle bars were bent so dunno if this can be remedied)

    what should be my next step?
    go through insurance or not?
    should i call her & discuss it or call insurance company first?
    or ask her if she wants to sort it outside of insurance?

    Were the guards called? Was she breathalysed? You got her insurance details? You make a claim against her insurer and it is dealt with. You could have spinal injuries that do not show for months so settling quickly for cash is not really advisable.

    Go through the insurance, it's so much easier and considering you went to hospital the chance of future injuries becoming apparent mean you will need to deal with the insurer IMO.

    Get a solicitor as soon as possible. Insurance companies make it as hard as possible for people to make claims and will pay the minimum possible. A mate of mine is 20 months trying to get a claim processed after a car came around a bend on the wrong side of the road and knocked him off his bike.

    When you're taken away in an ambulance, it's a serious accident, even if you're not crippled afterwards. In this case, going down the route of sorting it outside insurance is not feasible.

    You don't say whether it was motorbike or bicycle you were on. If it's motorbike, contact your own insurance company to file a crash report. They'll tell you what to do next. If it was a bicycle, then first and foremost ensure that you've filed a report with the Garda station which is local to the crash scene, then engage a solicitor who specialises in this area.

    I would be surprised if, anyone would sort 1500 outside their insurance.

    Having been knocked off my bike the full effects didn't hit me till a few days to a week later when whiplash set it. I did nothing about it at the time, but I regret it now. I would go the official route. Report it with the witness details to the Gardai, check for CCTV in the area that might have caught the accident. Then a claim on the insurance, through someone with experience in the area.
